Terms of Use
These terms are an agreement between you and 26Labs, the UK company that makes ProofStudy. Please read them before you use the app. If you do not agree to them, please do not use ProofStudy.
1. What ProofStudy does
ProofStudy turns study material you add into notes, practice questions and flashcards. It uses AI services to do this. Our Privacy Policy explains how your information is handled.
2. Subscriptions and payment
- Subscriptions are sold through Apple's App Store and paid to Apple. The price and what each plan includes are shown in the app before you buy.
- A subscription renews automatically each month unless you turn off auto-renewal at least 24 hours before the end of the current period. You can manage or cancel it in your Apple account settings.
- Refunds are handled by Apple under Apple's rules.
- Each plan has an allowance of AI work, shown in the app. When it is used up, AI features pause until the allowance renews or you change plan. Study material you have already made stays available.
- If we change a price, Apple tells you first, as Apple's rules require.
3. Your material
- You keep all rights in the material you add. You allow us, and the providers listed in our Privacy Policy, to process it only to provide ProofStudy to you.
- Only add material you have the right to use for your own study, such as your own notes or course material your school or college gives you.
- Do not add material that is illegal, or other people's personal information that you do not need for your study.
4. AI-made content can be wrong
ProofStudy checks its notes and questions, but AI can still make mistakes or leave things out. Always check important points against your course material and your teachers. ProofStudy is a study aid. It is not professional advice and does not guarantee any exam result.
5. Fair use
Please do not:
- use ProofStudy for anything unlawful, harmful or abusive;
- try to get around allowances, rate limits or security, or to reach our server other than through the app and our web pages;
- copy, resell or reverse engineer the app or our server, except where the law allows; or
- use automated tools to access the service, or overload it.
6. Send from computer
Send from computer lets you send your own study files from a computer browser to the ProofStudy app on your phone. The code shown in the app works for 15 minutes. Files are deleted from our server as soon as your phone collects them, and after 24 hours at most. File types and sizes are limited, as shown on the page. Use it only to send files to your own phone.
7. Changes and availability
We keep improving ProofStudy, so features may change. We try to keep the service available, but it may sometimes be unavailable, for example during maintenance or when an AI provider has problems. If we change these terms in a way that matters, we will tell you in the app before the change takes effect.
8. Ending
You can stop using ProofStudy at any time. Cancelling your subscription stops future payments. We may suspend or end access if these terms are seriously or repeatedly broken. Where it is fair to do so, we will tell you why first.
9. Our responsibility to you
- If you are a consumer, you have legal rights, for example under the Consumer Rights Act 2015. Nothing in these terms affects them.
- We are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, or for business losses.
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law.
10. Apple
- These terms are between you and 26Labs, not Apple. 26Labs, not Apple, is responsible for ProofStudy and its content.
- You may use ProofStudy on Apple devices that you own or control, as the App Store's Usage Rules allow.
- Apple has no obligation to provide maintenance or support for ProofStudy.
- If ProofStudy fails to meet any warranty that applies, you may tell Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for ProofStudy, as far as the law allows.
- 26Labs, not Apple, is responsible for dealing with any claims about ProofStudy, including product liability claims, claims that it does not meet legal or regulatory requirements, consumer protection claims, and claims that it infringes someone else's intellectual property.
- You confirm that you are not in a country subject to a US government embargo, and that you are not on a US government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple may enforce them against you.
11. Law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may also bring a claim in your local courts.
